                       CONFERENCE OF TRIBAL GOVERNMENTS

                             RESOLUTION #3-51579 
                           Indian Child Welfare Act             

PREAMBLE: Indian Tribes throughout the State of Washington actively 

supported the Indian Child Welfare Act, P.L. 95-608, passed in 1978 on 
November 7 by Congress. It has been the intent and desire of many to have 
jurisdiction over the destiny of their children and families. 

WHEREAS;    The Bureau of Indian Affairs was directed by Congress to 
            prepare the regulations for the implementation of the Indian 
            Child Welfare Act; and 

WHEREAS;    Those regulations were not initiated by the Bureau of Indian 
            Affairs until January of 1979, causing concern and distress 
            by Tribes who feared that the regulations would not reflect 
            the needs of Indian Tribes; and 

WHEREAS;    The Bureau of Indian Affairs published the regulations allowing 
            limited if any input in the development of those regulations, 
            even after Washington State Indian Tribes attended and 
            testified at a public hearing in the Seattle area; 

NOW THEREFORE BE IT RESOLVED that the Bureau of Indian Affairs is hereby 
            requested by the delegates to Session III of the Conference 
            of Tribal Governments to work towards revising the proposed 
            regulations on which comments are due by 5-23-75 to better 
            meet the needs and desires of Indian Tribes, and 

BE IT FURTHER RESOLVED that the Bureau of Indian Affairs should request 
            fair and equitable appropriations so that each and every 
            Indian Tribe be allowed to contract for those services author-
            ized in the Act to meet their needs, and 

BE IT FURTHER RESOLVED that the State of Washington actively initiate 
            communications with Indian Tribes of the State of Washington to 
            come to agreements regarding the Federal regulations and 
            Washington Administration Codes relating to the care and 
            jurisdiction of all Indian children and their families living 
            on or off the reservation.
